Kindly read this document carefully. The parties hereto must agree to the terms and conditions of this agreement before you may utilize the services of PrivateLetting Trust. PrivateLetting Trust refers to the websites www.PrivateLetting.co.za, www.PrivateLessor.co.za, www.RentalRates.co.za www.ProLet.co.za its subsidiaries, affiliates, officers, employees, trusts, companies and other legal affiliates. By utilizing the services provided on this platform, you agree to the terms, conditions and disclaimer set out herein.

This is a legal agreement between subscriber/user and PrivateLetting Trust. (IT 1636/05). This agreement states the terms and conditions upon which PrivateLetting Trust offers the use of software and services to the subscriber and /or user of this website, together with all related documentation and accompanying items including but not limited to, the executable programs, drivers, libraries and data files and data contained in such files associated with such programs (collectively; the software).

Our Business
Through its websites www.PrivateLetting.co.za, www.PrivateLessor.co.za, www.ProLet.co.za and www.RentalRates.co.za the PrivateLetting Trust provides a residential rental property management system enabling a direct relationship between owners and tenants to the benefit of both. Grant of subscription and use of Website
By utilizing this site, you have agreed to the terms and conditions of this agreement. By utilizing this site, you have further more subscribed to the service provided on www.PrivateLessor.co.za and you may be held thereto. Concerning the agreement between PrivateLetting Trust and yourself, PrivateLetting Trust retains all right title and interest to the ownership of the software and reserves all rights not expressly granted by PrivateLetting Trust. PrivateLetting Trust hereby grants you the right to use the software made available to you, provided that:

Software is only utilized within the ambit of the agreement
The software may not by appropriated in any endeavor to imitate or replicate the services provided by PrivateLetting Trust
The software may not be utilized to the detriment of any party
Copyright on the entire product belongs to PrivateLetting Trust
PrivateLetting Trust reserves the right to update the terms, conditions and disclaimers from time to time whenever the need arises
The information is available only to subscriber/users who have a permissible purpose. Disclosed information is limited to subscriber/users on the basis of relationship between needs, permissible purpose and the likely consumer benefit.

Payment Options
All transactions will be processed in South African Rands (ZAR) and we offer various payment options eg:

Electronic funds transfers (e.g. Internet payments).
Direct Deposit in our Bank account.
MasterCard payment.
Visa card payment.

Security Policy

Virtual Card Services process all credit card transactions. All credit card transactions are 128 bit Secure Socket Layers (SSL) encrypted. The company registration documents and the site registered domain name are checked and verified by Thawte, ensuring the cardholder and merchant that nobody can impersonate VCS to obtain confidential information.
Virtual Card Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. Virtual Card Services Internet servers are protected by firewalls and intrusion detection systems.
The Merchant does not have access to credit details.
Virtual Card Services continually reviews and enhances its security in line with technological changes.

Refund Policy
We offer a no-nonsense, no questions asked 7 days refund policy. If you are not completely satisfied with our services within the first 7 days send us an email to admin@PrivateLetting.co.za stating why you feel this way and that you would prefer to cancel your registration. Include your contact and bank account details and we will pay your registration money back and terminate your account. All other forms of notice will not constitute acceptance of any cancellation.

Data and Copyright
The subscriber/user hereby warrants accuracy of data and all information provided by subscriber/user will remain the property of the subscriber/user. The subscriber/user hereby instructs PrivateLetting Trust concerning the use of all information. The software is owned by PrivateLetting Trust and/or its licensors and is protected by the law of copyright.

The subscriber/user hereby agrees to abide by the PrivateLetting Trust condition, that only liquidated amounts will/may be used for listing purposes on Blacklist.co.za (Amounts which summary judgments may be taken on). No claims for damages or claims purporting to be claims for damages will be accommodated on Blacklist.co.za. It will be the sole prerogative and responsibility of the user/subscriber to assess and ascertain whether or not his claim against the debtor is for a liquid amount.

No Warranty
Any use of the software is at your own risk. The software and platform provided by PrivateLetting Trust, is provided for your convenience and PrivateLetting Trust gives no warranties of any kind. To the maximum extent permitted by law, PrivateLetting Trust disclaims all warranties of any kind, either express or implied, including without limitation, implied warranties or conditions of merchantability or fitness for a particular purpose. PrivateLetting Trust is not obliged to provide any updates or upgrades to the software.

PrivateLetting Trust will endeavor to ensure accuracy and currency; however, PrivateLetting Trust does not accept responsibility for any loss or damage, or any loss or damage that purports to be detrimental to any party as a result of the use of information contained herein. No guarantee is given as to the accuracy or currency of any or individual item on the www.PrivateLessor.co.za server. All access and use is at the risk of the user.

PrivateLetting Trust shall not be liable for the accuracy of any information provided on www.PrivateLessor.co.za or third parties, technical support personnel, or any damages caused, either directly or indirectly, by acts taken or omissions made by you as a result of such technical support.

In no event will PrivateLetting Trust’s liability to you or any other person ever exceed the amount paid by you to use the software, regardless of the room of the claim. PrivateLetting Trust shall have no liability for damages, including without limitation consequential damages.

Liability
PrivateLetting Trust hereby disclaims all warranties of any type, including any warranty of merchantability, fitness for a particular purpose and warranty of the accuracy of information contained in your credit profile or otherwise provided to you pursuant to this agreement. PrivateLetting Trust further disclaims any and all liability for negligence or lack of reasonable care and shall not be liable for any damages or losses whatsoever, whether direct compensatory, indirect punitive special consequential exemplary or incidental including without limitation of damages or loss of use, data or profits arising out of or in any way connected, incurred by yourself or any other person caused by PrivateLetting Trust or the services or information provided to yourself as a result of your application.

Warranty
Users and subscriber/users entering or supplying information to www.PrivateLessor.co.za warrants that all information supplied falls within their personal knowledge and that by utilizing this website, the user explicitly warrants that all information supplied to www.PrivateLessor.co.za in any form whatsoever, as well as any and all information entered onto www.PrivateLessor.co.za is both true and correct. Further the user explicitly warrants that this website will not be utilized for any unlawful purpose or any action prohibited in South Africa or international law or that is in contradiction to the terms and conditions contained herein.

Indemnification
The subscriber and user hereby indemnifies PrivateLetting Trust from any claim whatsoever, including but not limited to all claims, demands, cost or damage, including any kind of detriment caused, including attorneys fees asserted by any third party arising out of a customer’s use of or conduct on the software. PrivateLetting Trust has no liability arising from any information supplied by any user infringing or allegedly infringing on the private rights of a third party. The subscriber/user accepts the fact that information on the Internet is not 100% secure and therefore use the website at own risk. Any transmission of data on or through the use of PrivateLetting Trust sites is at your own risk. Should any one of the clauses or parts thereof in this agreement prove to be invalid, it shall not affect the validity of the rest of the agreement.

All users utilizing www.PrivateLessor.co.za and subscribers that subscribe to www.PrivateLessor.co.za do so on their own initiative. Should you not agree to be legally bound by the terms of this agreement, you should not make use of the service offered on this site, or attempt to do so.
